1. Introduction
1.1 These terms and conditions shall govern your use of our website, with specific reference to Shipping and Delivery of goods purchased from Gemsstar Jewelers (www.gemsstar.com).
1.2 By using our website, you accept these shipping and delivery terms and conditions in full; accordingly, if you disagree with these terms and conditions or any part of these terms and conditions, you must not use our website.
1.3 You must be at least 18 years of age to use our website; and by using our website or agreeing to these terms and conditions, you warrant and represent to us that you are at least 18 years of age.
1.4 Our website uses cookies; by using our website or agreeing to these terms and conditions, you consent to our use of cookies in accordance with the terms of our Privacy Policy.
1.5 Gemsstar Jewelers (www.gemsstar.com) retains the right to change/ amend/ update this policy without notice or written communication. All changes will reflect on our website.
2. Shipping and delivery policies
2.1 Gemsstar Jewelers (www.gemsstar.com) ships to USA, UK, India, Australia, Canada and most European countries; with the exception of a few.
2.2 All our orders are shipped through registered courier companies and post offices.
2.3 We do NOT offer free shipping services. Shipping of any and every order will be charged according to standard shipping rates. To know more about our shipping rates, kindly visit our Shipping Policy page.
2.4 We do NOT offer Cash On Delivery as an option. All orders must be paid for in full at the time of placing the order.
2.5 We will ship orders as per the delivery date agreed at the time of order confirmation. All order deliveries will be subject to the norms, terms, conditions and policies of the courier companies associated with Gemsstar Jewelers (www.gemsstar.com). Current status of your orders / shipments can be tracked on our website using the my accounts section once you are logged in.
2.6 All orders will be shipped to the registered postal address of the buyer within India (as specified at the time of registration or order confirmation). For order(s) being shipped outside India, you can call us for details on +91-22-2646-9109 or write to us at gemsstar37@gmail.com .
2.7 If payment for an order is being made by bank deposit or transfer of cash into our account (details provided on our payment method pages), that order will only be shipped once payment has been received irrevocably, in full.
2.8 Gemsstar Jewelers (www.gemsstar.com) has partnered with various global logistic service providers to ensure timely delivery of products purchase on our website. In normal circumstances, packages are shipped within 4-6 business days. However, the stipulated delivery time may vary in case of multiple orders, Tier-3 cities, and various other contingencies.
3. Limitations and exclusions of liability
3.1 We will not be liable to you in respect of any delay in delivery by the courier companies associated with our website. Gemsstar Jewelers (www.gemsstar.com) only agrees to hand over the consignment to the courier company within 15 working days from the date of the order and payment, or as per the delivery date agreed at the time of order confirmation.
3.2 We agree to dispatch only undamaged orders to the courier company associated with your order as per the delivery date agreed at the time of order confirmation. We will not be responsible in any way for any damage to orders during transit. Buyers will need to contact the courier company associated with their order to settle disputes regarding receipt of goods damaged in transit.
4. Proof of delivery
4.1 Gemsstar Jewelers (www.gemsstar.com) is not responsible and cannot be held liable against non-receipt of e-mails / e-mail delivery failure caused by technical difficulties / registration of incorrect e-mail address by the customer.
4.2 Any and all disputes that may arise as a result of goods shipped and received, must be provided in writing to Gemsstar Jewelers (www.gemsstar.com) within 7 days of receipt of the delivery confirmation e-mail. If no response is received within 7 days of receipt of the delivery confirmation e-mail, the same will be deemed as confirmation of the buyer/recipient having received the goods shipped. Gemsstar Jewelers (www.gemsstar.com) is under no liability thereafter regarding the said order.
5. Cancellation
5.1 Once a product is shipped to the recipient (is handed over to the courier company by us), and/or you receive the product, the order cannot be cancelled under any circumstances. Please be advised that some orders are shipped almost immediately.
5.2 If you wish to cancel an order prior to shipping, please intimate our representatives via telephone by calling +91-22-2646-9109. Please note: If you cancel an order before the product(s) has been shipped to you, kindly contact us via e-mail at gemsstar37@gmail.com and we will provide you with further instructions. We do NOT offer Cash On Delivery, hence refunds cannot be claimed against Cash On Delivery in any instance. Exchanges for cash / cheque / currency / bank transfer / any other monetary form will NOT be entertained under ANY circumstance. The right to accept or refuse returned order/s lies at the sole discretion of Gemsstar Jewelers (www.gemsstar.com) and its representatives. To complete your return, we require a receipt or proof of purchase. Kindly read our Cancellation Policy carefully prior to purchasing any product(s) via our website.
6. Returns & replacements
6.1 In case you are unhappy with the quality of the goods shipped, or the goods don't fit you properly, you can return the good to us (meeting the terms and conditions given in 6.1 and 6.2). You must intimate us regarding the good/s you would like to return within 7 days of receiving delivery of your order(s). If all return criteria are met, we will replace the product (of the same value as item/s returned after deducting shipping / courier charges). Exchanges for cash / cheque / currency / bank transfer / any other monetary form will NOT be entertained under ANY circumstance. To complete your return, we require a receipt or proof of purchase.
6.2 All products returned (as intimated to us) should be unused and couriered back to us in original condition with all the packaging, tags, clips, hangers, and promotional material intact (as applicable to the product returned) within a period of 14 days from the date you receive delivery of your order(s). In case you should wish to return your order(s), kindly intimate us by calling +91-22-2646-9109 or writing to us at gemsstar37@gmail.com . Thereafter, we will send you an e-mail explaining the return procedure and the address where the returned order(s) should be shipped. All courier charges applicable on shipment of good/s to be returned must be borne by the customer. No reimbursement will be made in any other circumstance. In case the return criteria are not met, the product will be re-shipped to the customer’s delivery address at the sole expense of the customer.
6.3 In order to initiate the return procedure, we must receive the products at our registered operating address (which will be provided to you in an e-mail once we are intimated that you would like to return your order.) Shipping costs are non-refundable. If a product exchange is approved by Gemsstar Jewelers (www.gemsstar.com), the cost of return shipping or shipping of freshly ordered good/s will be solely borne by the buyer/customer.
6.4 Only regular priced items may be exchanged or returned. However, the right to accept or refuse returned order/s lies at the sole discretion of Gemsstar Jewelers (www.gemsstar.com) and its representatives. Unfortunately, order/s or item/s purchased within Sale / Offer periods CANNOT be returned or exchanged under any circumstance.
